1. Editor ID

Software DisaTime is edited and operated by:

• Country : Belgique

Hereinafter referred to as the Editor.

2. Purpose of the software

DisaTime is an online computer application that allows for:

• management of time entries
• the management of professional benefits
• monitoring of activities
• the calculation of costs
• preparation or generation of invoices

The software is offered as a SaaS service.

3. Acceptance of conditions

The use of the software implies full acceptance of these terms and conditions. The customer acknowledges that he has read the terms and conditions before any use of the service.

4. Licence to use

The Publisher grants the client a limited, non-exclusive and non-transferable license to use the software.

• valid during the term of the contract or subscription
• limited to the client's professional needs
• not allowing any reproduction, modification or resale of the software

5. Intellectual property

Software DisaTime, including the source code, database structure, interface, algorithms and documentation, remains the sole property of the Editor.

The client has no ownership rights over the software.

7. Data privacy

L-editor undertakes to respect the strict confidentiality of the data stored in the software.

• do not consult the data
• does not exploit them
• do not communicate them to third parties
• does not use them for commercial purposes

Access to data may only be provided in the event of requested technical assistance, a diagnosis of a technical incident or a legal obligation.

8. Data backups

In order to ensure continuity of service, several safeguard mechanisms can be put in place.

Hoster backups

The hosting infrastructure can perform regular automatic backups, especially daily.

Security backups by Editor

L-editor may retain backup copies of databases only for the purpose of technical restoration or prevention of data loss.

9. Security

L-Publisher implements reasonable technical measures to protect data.

• secure access
• Encryption of communications
• regular backups
• Technical monitoring of systems

However, no IT infrastructure can guarantee absolute security.

10. Client responsibility

The customer is responsible for the data that he or she registers, the management of user accounts and compliance with applicable legislation.

The client undertakes not to use the software for illegal purposes.

11. Limitation of liability

The Editor shall not be liable for errors in encoding, decisions made on the basis of software information or temporary unavailability of the service.

The total liability of the Editor is limited to the amount paid by the Client in the last 12 months.

12. Availability of service

The Editor strives to ensure the availability of the service. Temporary interruptions may occur for maintenance, updates, technical incidents or events beyond his control.

13. Export and termination

The customer may request an export of his data in a usable format within a reasonable time. In the event of termination, the data may be deleted after a reasonable time.

14. GDPR data protection

In the context of the use of the software, the client acts as the controller and the Editor acts as a technical subcontractor.

15. Communications and newsletter

When creating a corporate account on the DisaTime, the customer agrees to receive electronic communications relating to the operation of the service, including updates, developments, new features, legal obligations, security information, maintenance or any other information useful for the use of the platform.

The customer can also receive the newsletter DisaTime containing information on new products, advice, news and offers relating to the services offered by DisaTime.

In accordance with Regulation (EU) 2016/679 (GDPR) and the applicable regulations on electronic communications, the customer may withdraw his consent or unsubscribe free of charge from these marketing communications at any time, including through the unsubscribe link in each email or by contacting DisaTime.

16. Technical contractors

The Editor may use technical subcontractors, including hosting, backups or IT infrastructure.

17. Force majeure and applicable law

The Editor shall not be liable for any delay or interruption resulting from a case of force majeure.

These conditions are subject to Belgian law. Any dispute falls within the jurisdiction of the courts of the head office of the Editor.
