Use of the software implies full acceptance of these conditions. The customer acknowledges having read the conditions before using the service.
The Publisher grants the customer a limited, non-exclusive and non-transferable license to use the software.
The DisaTime software, including in particular the source code, database structure, interface, algorithms and documentation, remains the exclusive property of the Publisher.
The customer has no ownership rights over the software.
The data recorded in DisaTime remains the exclusive property of the customer.
The Publisher only acts as a technical infrastructure provider and does not use this data.
The Publisher undertakes to respect the strict confidentiality of the data recorded in the software.
Access to data can only take place in the event of technical assistance requested, diagnosis of a technical incident or legal obligation.
In order to guarantee continuity of service, several backup mechanisms can be put in place.
The hosting infrastructure can perform regular automatic backups, especially daily.
The Publisher may retain backup copies of databases solely for the purposes of technical restoration or data loss prevention.
The Publisher implements reasonable technical measures aimed at protecting the data.
However, no IT infrastructure can guarantee absolute security.
The customer is responsible for the data he records, the management of user accounts and compliance with applicable legislation.
The customer undertakes not to use the software for illegal purposes.
The Publisher cannot be held responsible for encoding errors, decisions made based on software information or temporary unavailability of the service.
The Publisher's total liability is limited to the amount paid by the customer during the last 12 months.
The Publisher strives to ensure the availability of the service. Temporary interruptions may occur for maintenance, updates, technical incidents or events beyond its control.
The customer can request an export of his data in a usable format within a reasonable time. In the event of termination, the data may be deleted after a reasonable period of time.
When using the software, the customer acts as data controller and the Publisher acts as technical subcontractor.
When creating a company account on DisaTime, the customer agrees to receive electronic communications relating to the operation of the service, in particular concerning updates, developments, new features, legal obligations, security information, maintenance or any other information useful to the use of the platform.
The customer can also receive the DisaTime newsletter containing information on new features, advice, news and offers relating to the services offered by DisaTime.
In accordance with Regulation (EU) 2016/679 (GDPR) as well as the regulations applicable to electronic communications, the customer may withdraw his consent or unsubscribe free of charge from these marketing communications at any time, in particular via the unsubscribe link present in each e-mail or by contacting DisaTime.
The Publisher may use technical subcontractors, in particular for hosting, backups or IT infrastructure.
The Publisher cannot be held responsible for delays or interruptions resulting from force majeure.
These conditions are subject to Belgian law. Any dispute falls under the jurisdiction of the courts of the Publisher's headquarters.
